The promissary contract is when we agree to pay the deposit of 10% and also agree the date of the completion. In our case, probably a week.

We cannot nor should we have access to the property beforehand.

The promissary is a binding legal document, which means that if we pull out of the sale, we have to give the owners of the property 22,000€, which is double the deposit.

Carla and us are wondering why they have to involve a solictor, as it's really not needed - the only thing we can thin of is that they have power of attorny, as the actual owner is in a home in England, with dementia.

The law over here is very much open to your own interpretation and obviously, this solicitor is making sure he/she takes as much money as possible. :twisted:

We could have done both the sale and purchase, just using the agents, especially as they're both from the same company.

I know you said the promissory is binding...that's why I'm worried they're pushing you for money, if it hasn't been signed.
Same as exchange of contracts here, you both do it at the same time.

But again, the contract can also state that, if our sale falls through, they give us back our deposit and we don't have to pay them any more than that.

And we'd have to have a definate time-scale set.

Carla has to take her daughter for an colonoscopy today, but once that's out of the way, she'll be in touch with Tom.

We're not sure if it's him pushing, or them.

We know the people who want our house are 100% wanting it, there is a small legal hitch, one son is in London, the other is in the Canaries and trying to get it all translated into Portuguese, as they also have to agree, is a complete nightmare. But that's normal over here. Families are very spread out and they all have to agree :roll: :roll: :roll:

The people we're buying from know we're 100% buying their place, so it's just a question of waiting for the translation to be done.

And Carla having a right go at Tom, for this co-ownership rubbish.

We didn't have to do it when we bought our house here, she's very angry.

And then think of an angry hornet, because she really really wants us "her stone in her shoe" out of the way :lol: :lol:

But we have a price for van for a couple of days, to move the lighter stuff, 120€, which we're happy with. We can do that over a couple of days, Luis and his brother can do the heavy stuff whenever, as Carla has written in the final deed that we have a month to move out, as they've been peeing us all off :lol: :lol: :lol:
