Not quite. Currently those who give a positive on the hand-held breathalyser are taken to the station and give two more sample on sensitive and calibrated equipment or bloods if it is a drug test. If they fail those they go to the magistrates for a ban and points, but in the meantime can still drive.
Under the new proposals, if they fail at the station, they would get an immediate ban and then go to the magistrates to find out the length of the ban and number of points - a subtle difference.
I am not against that.
