CJEU Rules on the "Rule of Law" for EU funds

Postby Suff » 16 Feb 2022, 16:58

The court dismissed the challenges from Poland and Hungary. Leaving the route clear for the Commissions to slash funds to both Hungary and Poland.

The reporters who look at this stuff recon that Poland and Hungary will immediately challenge any restriction of funds in the courts. Leading to another lost year or two.

Then there is the Veto. Between them Poland and Hungary could hold up every important legislation that the EU wants to pass by vetoing it. Including the new TFEU treaty negotiations which are to be completed in the next parliament.

The last thing the EU needs right now, with Russian probing for weakness, is disunity. But that seems to be what they are going to get.

Apparently the rule of law should only be enacted if EU money is at risk of misuse. That, I suppose, can be interpreted in many different ways so the court could be very busy..

However, there is no doubt that there is an open sore between Brussels and some of the newer member states - former Warsaw Pact countries. They have still not fully bought in to Western values, especially social and humanitarian ones, and that will take time and a lot of persuasion.

There is that. However I also see that these countries rushed out their judiciary and constitution post the fall of the USSR. Yet, it appears, they can't make decisions to change the way they work. Just because those opposing it are making a huge noise.

I note that those not opposing it keep on voting the changes into power with a large majority. But that, apparently, aint democracy. Just because the people of Poland and Hungary don't want woke laws and are willing to vote to ensure they don't get them; that doesn't mean they can have that. I mean, it's undemocratic!

The money angle is one of the few power tools the EU has to keep the member states in line and, as we have seen with France, with multiple outstanding fines they won't pay, the easiest way to control the states are where they are net recipients so they can deny money. Poland especially.

What I see is a large chunk of turbulence in the EU when they really do need to be united in the face of unbridled pressure from the east.

I'm worried that these EU states driving the situation are so firmly embedded in what they "want" that they cannot see what it will "cost".

Fighting within can always be put on hold or delayed till another day - containable.

Fighting those on the outside has to be dealt with according to the attacker's rules - uncontrolled.

This will be put on the back burner till the Russian thing is sorted. Priorities.

We can hope. They just need to get that through to the parliament.
