I end up the loser

Postby lissie » 14 Jun 2015, 09:56

I am so upset and still shaky after the accident and covered in bruises but what
upsets me is that i will end up the loser through no fault of my own :( :(
We bought my little Toyota Yaris about 3 years ago for £3500 and it was still
immaculate and we were looking to keep it for another couple of years.
Now all i will get is £1200 according to Glasses Guide as it is a write off :(
I won`t get anything as good for that money and can`t afford more so we
end up losers
Seems so unfair.

Lissie, assuming your policy was fully-comp you do not have to accept, you can fight.

The other driver was 100% at fault so you have a no-fault claim. This is what happened with my bike accident. The original offer was a 50:50 deal, but I kept on fighting and eventually won. The payment I received was for a replacement bike of the same age, specification and condition in the market and not based on Glasses Trade Guide. I also got a payment for incidentals such as bus and taxi fares.

It is the other driver's insurers playing the game. Do not bow to their pressure and be prepared to go to court if necessary - let them know that.

Lissie.
As WM has said, do not accept the first offer. The insurance company of the lorry are trying to pay out the minimum. I know, I worked for some of them, not in claims.
Try and find a car like yours which is for sale and then ask for that and add 10% as the settlement figure.

I am so sorry Lissie, and hope the WM's and cruiser's advice might help ((((((((x)))))))))

As an aside my MIL has a Yaris and absolutely loves it!

That is exactly what my solicitors suggested. I got three prices from the internet and stuck to my guns. I saved the pages with the details to my computer for future reference.
